01 Agreement and services

These Service Terms & Conditions apply when they are presented in connection with a service request or transaction and accepted by signature, checkbox, electronic authorization, or another legally effective method. They supplement the applicable written estimate, work order, authorization, invoice, and any other transaction-specific agreement. Merely visiting this website does not authorize repairs.

Mobile Tire Team may provide tire repair, replacement, installation, balancing, rotation, spare-tire swaps, tire-pressure monitoring system services, roadside or mobile tire assistance, new or used tire sales, and other specifically authorized automotive services. Services are commonly performed at a location selected by the customer, subject to safety, access, equipment, product availability, and applicable law.

02 Customer information

The customer must provide materially accurate and complete information reasonably needed for the job, including the vehicle year, make, model, tire size, wheel and tire specifications, exact service location, wheel-lock information, known modifications, known damage or problems, and relevant service circumstances.

To the extent permitted by law, the customer is responsible for reasonable, previously disclosed costs, delays, unsuccessful dispatches, incompatible products, or additional work materially caused by inaccurate or incomplete customer information. No additional repair is performed or charged without authorization when authorization is required.

03 Quotes, estimates, and authorization

A preliminary quote given by telephone, text message, or website may be based on customer-provided information and visible conditions. Unless it is expressly identified and documented as the required repair estimate, it is not the final written estimate or authorization for repair.

Price, product, or scope may change after inspection because of an incorrect tire size or vehicle configuration, damaged wheels or tires, seized hardware, wheel-lock problems, tire-pressure monitoring system issues, modifications, hidden conditions, incompatible products, or additional labor. Mobile Tire Team provides estimates, obtains authorization before work, documents additional work and price changes, and provides invoices as required by applicable California automotive repair law. A customer may decline additional work.

04 Arrival windows and ETAs

Quoted arrival windows and ETAs are good-faith estimates, not guarantees, unless Mobile Tire Team separately provides an express written guarantee. Timing may be affected by traffic, weather, road closures, earlier service calls, emergencies, supplier availability, mechanical or equipment problems, and other circumstances outside reasonable control.

05 Safe service location and vehicle access

The customer must provide lawful, reasonably safe access to the vehicle and sufficient space to perform the authorized work. Mobile Tire Team may refuse, stop, delay, or require relocation of service when a technician reasonably determines that the location is unsafe, inaccessible, unlawful, unsuitable, or creates unreasonable risk. Examples include traffic exposure, an insufficient shoulder, unstable or uneven ground, dangerous weather, poor visibility, prohibited work areas, insufficient clearance, unsafe vehicle positioning, or threatening conduct.

06 Used tires

By purchasing or authorizing installation of a used tire, the customer acknowledges that the tire has been previously used and may contain normal wear from prior service. Remaining tread life, mileage, performance, and future service life cannot be guaranteed.

Used tires may show prior wear and cosmetic or mounting marks consistent with prior use and do not have the expected remaining service life of a new tire. Mobile Tire Team does not provide an independent voluntary warranty on used tires. Mobile Tire Team will not knowingly install a used tire that it determines is unsafe or prohibited from installation. Any non-waivable rights and required transaction-specific disclosures remain applicable.

07 Tire inspection and repairs

Not every tire is repairable. A technician may need to remove and inspect a tire before determining repairability, and hidden or internal damage may exist. Damage outside a repairable area, excessive wear, run-flat damage, structural damage, or other unsafe conditions may require replacement.

A repair addresses only the authorized repairable condition identified at the time of service. It does not guarantee against future unrelated punctures, leaks, impact damage, misuse, pressure loss, or tire failure, and Mobile Tire Team provides no independent voluntary warranty regarding the future service life of a repaired tire. This does not waive any duty to perform an authorized repair in the manner required by law.

08 Warranties and new products

Unless Mobile Tire Team expressly provides a separate written warranty, Mobile Tire Team does not provide an independent voluntary warranty on labor, installation, tire repairs, used tires, or services.

Any applicable warranty on a new tire or other new product is provided by its manufacturer and is subject to that manufacturer's eligibility requirements, exclusions, mileage or time limits, documentation, and claim procedures. Mobile Tire Team may reasonably assist with information available to it but does not control the manufacturer's decision to approve or deny a claim. Nothing in these Terms disclaims a warranty, remedy, or obligation that cannot lawfully be disclaimed.

09 Final sales, refunds, and exchanges

To the extent permitted by law, completed labor charges and completed mobile, travel, dispatch, or service-call services are final. Mounted or installed tires, tires driven on, used tires, and products damaged or altered after delivery are not returnable. A return request may be denied when the product is no longer in new, unused, unmounted, and resalable condition.

Properly disclosed special-order products may be final sale. This policy does not eliminate any refund, replacement, repair, cancellation, or other remedy required by law, or any applicable manufacturer warranty. Transaction-specific return terms disclosed before purchase also apply.

10 Special orders and deposits

When disclosed before purchase, special-order tires or products may be final sale, and a deposit may become non-refundable after Mobile Tire Team commits the order to a supplier. The applicable quote, estimate, work order, receipt, or other transaction record will state any deposit or cancellation term that applies. No undisclosed fixed cancellation fee or non-refundable deposit is created by these Terms alone.

11 Pre-existing conditions and documentation

Mobile Tire Team is not responsible for a condition or damage that existed before service and was not caused by Mobile Tire Team. Examples include rim scratches, curb rash, bent or cracked wheels, corrosion, peeling or chipping finish, prior refinishing or wheel repairs, damaged lug nuts, studs, wheel locks, valve stems, tire-pressure monitoring system faults, tire damage, modifications, and other existing defects.

Mobile Tire Team may reasonably photograph, record, or otherwise document the vehicle, tire, wheel, service location, pre-existing condition, and completed work for service, safety, quality, authorization, claim, or dispute purposes. These Terms do not excuse damage actually caused by Mobile Tire Team for which liability cannot lawfully be excluded.

12 Specialty and aftermarket wheels

The customer must disclose known special characteristics of painted, powder-coated, chrome, refinished, repaired, aftermarket, custom-finish, or otherwise specialty wheels. Pre-existing deterioration, corrosion, prior damage, poor refinishing, or a compromised coating may make a finish or component more susceptible to chipping, peeling, cracking, or deterioration during ordinary tire service. This provision does not disclaim responsibility for damage caused by improper work.

13 Customer-supplied tires and parts

The customer is responsible for the compatibility, specifications, condition, and suitability of a customer-supplied product. Mobile Tire Team may refuse to install a product that reasonably appears incorrect, incompatible, damaged, unsafe, or inappropriate for the vehicle or intended use. Mobile Tire Team provides no product warranty on customer-supplied goods. Non-waivable obligations for authorized labor remain unaffected.

14 Tire-pressure monitoring systems

Tire-pressure monitoring system issues may result from pre-existing sensor battery depletion, age, corrosion, electronic failure, prior damage, programming or communication problems, or vehicle-side faults. Tire service alone does not guarantee correction of an unrelated system problem. Diagnosis, replacement, programming, relearning, or other separately authorized service may be required.

15 Lug nuts, studs, and wheel locks

The customer must provide any required wheel-lock key. Components may be seized, corroded, rounded, cross-threaded, stripped, broken, damaged, missing, or previously installed incorrectly. Mobile Tire Team may stop or decline work when continued service could cause damage or create a safety risk. Replacement, extraction, or other additional work requires separate authorization when required.

16 Vehicle modifications

The customer must disclose known modifications that materially affect service, including lowered suspension, lift kits, spacers, aftermarket wheels, custom lug hardware, modified brakes or suspension, and unusual loading. Mobile Tire Team may decline or stop service when its available equipment cannot safely access, lift, secure, or service the vehicle.

17 Unrelated vehicle conditions

Tire service does not diagnose or correct unrelated alignment, suspension, steering, wheel-bearing, brake, drivetrain, electrical, tire-pressure monitoring electronics, or pre-existing wheel conditions unless that work is specifically authorized. Discovering or noticing an unrelated condition after tire service does not by itself establish that Mobile Tire Team caused it. Legitimate claims remain subject to the facts and applicable law.

18 Customer responsibility after service

After service, the customer should promptly respond to abnormal pressure loss, vibration, unusual noise, warning lights, pulling, visible damage, or any indication of a loose wheel or tire problem. If a dangerous condition is known or reasonably apparent, stop operating the vehicle as soon as it is safe and contact Mobile Tire Team or another qualified service provider. Continued operation can cause additional damage or injury.

19 Cancellations, dispatch, and no-shows

A dispatch, travel, cancellation, or service-call charge applies only when it was disclosed before it was incurred or otherwise lawfully agreed. An applicable charge may be due when a technician has been dispatched and the customer cancels, provides a materially incorrect location, cannot provide vehicle access, fails to appear, or prevents the authorized service from being performed. These Terms do not create an undisclosed fixed fee.

20 Payment and chargebacks

Payment is due according to the agreed transaction terms. Mobile Tire Team may use customer authorizations, communications, service records, photographs, transaction records, estimates, work orders, invoices, and other legitimate documentation to respond to an improper or fraudulent chargeback. Nothing in these Terms waives a lawful billing-dispute or chargeback right.

21 Third-party and sublet services

Mobile Tire Team may use another qualified business or technician in connection with an authorized job when lawful and appropriate. Required sublet disclosures and customer consent will be obtained, and requested information about the facility performing sublet work will be provided, as applicable. Mobile Tire Team does not use these Terms to avoid any responsibility for authorized sublet work that California law makes non-waivable.

22 Refusal or termination of service

Where lawful, Mobile Tire Team may refuse, pause, or discontinue service because of unsafe conditions, threats, harassment or abuse, suspected fraud, an unlawful request, inability to obtain authorization, an incompatible vehicle or product, unavailable equipment, or inability to perform the work safely and properly.

23 Events outside reasonable control

Mobile Tire Team is not responsible for delay or failure in performance materially caused by events outside its reasonable control, including severe weather, natural disasters, fires, road closures, government orders, labor disruptions, utility or communications outages, supplier disruptions, extraordinary transportation problems, or emergencies. This section does not excuse an obligation that cannot lawfully be excused.

24 Limitation of liability

To the maximum extent permitted by law, Mobile Tire Team is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from a service or transaction when such damages may lawfully be limited. This limitation does not apply to fraud, willful injury, violation of law, gross negligence where it cannot be limited, or any other liability or remedy that applicable law does not permit the parties to waive or limit.

25 Narrow customer indemnification

To the extent permitted by law, the customer will indemnify Mobile Tire Team against a third-party claim to the extent the claim is caused by the customer's materially false information, unlawful conduct, intentional misuse of a product or completed service, material breach of these Terms, or provision of an unsafe or incompatible customer-supplied product. This obligation does not apply to the extent a claim is caused by Mobile Tire Team's negligence, willful misconduct, violation of law, or another basis that cannot lawfully be shifted to the customer.

PLEASE READ THIS SECTION CAREFULLY. IT PROVIDES FOR BINDING INDIVIDUAL ARBITRATION AND A WAIVER OF JURY AND CLASS PROCEEDINGS, SUBJECT TO THE EXCEPTIONS AND NON-WAIVABLE RIGHTS BELOW.

26 Informal resolution and binding arbitration

Before starting arbitration, the party asserting a dispute must send the other party a written notice describing the claim and requested relief and allow 30 days for a good-faith effort to resolve it. A customer may send notice to Mobile Tire Team using the contact information in Section 33.

Except for a claim eligible for small claims court or a right or remedy that cannot lawfully be arbitrated or waived, any dispute or claim between a customer and Mobile Tire Team arising out of or relating to a product, service, quote, estimate, authorization, payment, transaction, these Terms, or the relationship between the parties will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under the AAA Consumer Arbitration Rules in effect when the demand is properly filed.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement. The arbitrator will be appointed according to the applicable AAA rules. Hearings may be conducted remotely, and any in-person hearing location will be determined under the AAA Consumer Arbitration Rules, taking applicable consumer protections into account.

Either party may bring an eligible individual claim in small claims court. Either party may also seek temporary or emergency relief from a court when needed to preserve the status quo pending arbitration. Nothing in this section prevents a party from pursuing public injunctive relief or another right or remedy that cannot lawfully be waived or required to be arbitrated.

Arbitration will proceed only on an individual basis. To the extent permitted by law, neither party may bring or participate in a class, collective, consolidated, coordinated, or representative proceeding in arbitration, and the arbitrator may award relief only for the individual party seeking it and only as necessary to resolve that party's individual claim. If a final decision holds that a particular claim or requested remedy cannot be subject to this individual-proceeding requirement, only that claim or remedy will proceed in court after all arbitrable matters are completed, unless applicable law requires otherwise.

Arbitration may be initiated by submitting a Demand for Arbitration to AAA as provided in its rules. The current rules, forms, and filing instructions are available at adr.org. Consumer filing fees and Mobile Tire Team's payment obligations will be governed by the applicable AAA Consumer Arbitration Rules and fee schedule, including any available consumer fee waiver. Each party may be represented by an attorney at its own expense, subject to any fee-shifting remedy available under applicable law or awarded by the arbitrator.

The arbitrator may award any individual remedy available in court that is not lawfully waivable. Judgment on the award may be entered in any court with jurisdiction. If any part of this arbitration section is found unenforceable, it will be severed to the minimum extent necessary and the remainder will remain effective, except as specifically provided above for the individual-proceeding requirement.

27 Governing law and court venue

California law governs these Terms, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs the arbitration agreement. For a court proceeding not subject to arbitration, Santa Clara County, California will be the agreed venue only to the extent that such a venue agreement is legally effective for the particular dispute. Any mandatory venue right remains available.

28 Severability and no waiver

If a provision is held invalid or unenforceable, it will be enforced to the greatest extent permitted and the remaining provisions will continue in effect, subject to the arbitration-specific terms in Section 26. Failure to enforce a provision on one occasion does not waive future enforcement of that or any other provision.

29 Assignment

To the extent permitted by law, the customer may not assign rights or obligations under an applicable service agreement without Mobile Tire Team's written consent. Mobile Tire Team may assign an agreement in connection with a legitimate merger, reorganization, financing, or sale of all or substantially all relevant business assets, subject to applicable law and without reducing non-waivable customer rights.

30 Entire agreement and transaction documents

These Terms, together with the applicable written estimate, work order, authorization, invoice, and other transaction-specific written agreement, form the agreement for the covered transaction. A transaction-specific document controls as to the authorized work, products, price, and terms expressly stated there. Nothing in this section replaces, limits, or conflicts with documentation or authorization required by California law.

31 Changes to these Terms

Mobile Tire Team may update these website Terms prospectively. The effective date will be revised when an update is posted. A website update does not retroactively change the terms governing a completed transaction. The version accepted or otherwise legally applicable to the transaction controls.

32 Communications, call recording, and SMS terms

Calls may be recorded or transcribed for customer service, service documentation, scheduling, quality assurance, dispute resolution, and automation after required notice and consent are provided. Visiting this website alone does not constitute consent to recording.

Mobile Tire Team provides mobile tire services. Customers who consent may receive transactional messages related to requested services, including quotes, scheduling, appointments, ETA and arrival notices, service updates, requests for vehicle or tire information, and follow-up concerning an active service request. Consent to receive automated text messages is not a condition of purchasing a product or service.

Message frequency varies. Message and data rates may apply. Reply STOP to opt out. Reply HELP for assistance. SMS support is 916-333-0932. Mobile information and SMS opt-in consent are not sold or shared with third parties or affiliates for their own marketing or promotional purposes. For more information, review our Privacy Policy.
